# SMS Messaging Policy

Last updated September 30, 2026

This SMS Messaging Policy explains how Swayvia ("we", "us", "our") sends text messages and how you can control them. It is an addition to our [Privacy Policy](https://swayvia.com/privacy), [Terms of Service](https://swayvia.com/terms), and [Cookie Policy](https://swayvia.com/cookies), and should be read together with them.

## 1. Who we are and how we text

Swayvia provides lead follow-up, customer reactivation, and appointment-setting services to businesses. We send text messages in two ways:

- **On behalf of our business customers.** Our customers ask us to reach out to their own past customers and leads. These messages come from a number we operate for that business, and they identify the business they are sent for.

- **From us directly.** If you submit a form on our website or otherwise ask us to contact you, we may text you about your inquiry, appointments, or our services.

## 2. Types of messages

Depending on how you connected with us or with one of our customers, messages may include:

- Follow-ups and check-ins about past services or inquiries

- Appointment scheduling, confirmations, and reminders

- Responses to questions you sent us

- Promotional offers or updates from a business you have dealt with before

Some of these messages are marketing messages. We do not send messages unrelated to these purposes.

## 3. Consent

We send text messages only to people who have given the consent the law requires. For marketing texts, and for texts or calls sent with automated technology (including AI assistants), that means **prior express written consent**. Having done business with someone in the past does not replace that consent.

- **Our website:** By checking the SMS consent box on one of our forms and submitting your mobile number, you agree in writing (by electronic signature) to receive marketing and informational text messages from Swayvia at that number, which may be sent using automated technology. Consent is not a condition of buying any goods or services.

- **Our customers' contacts:** Before we contact anyone on a customer's list, the customer confirms to us in writing that they hold the consent the law requires and can provide a record of it on request. If you believe you were texted without your permission, contact us using the details in Section 10 and we will look into it right away.

## 4. Message frequency, timing, rates, and carriers

- Message frequency varies depending on your conversation with us or the business contacting you.

- We send messages only during the hours the law allows where you are, which can be narrower than the federal 8:00 a.m. to 9:00 p.m. window.

- **Message and data rates may apply.** Charges depend on your mobile plan.

- Carriers are not liable for delayed or undelivered messages.

- Availability depends on your wireless carrier and coverage.

## 5. How to opt out or get help

- **To stop messages:** Reply **STOP** at any time. You may also reply CANCEL, UNSUBSCRIBE, END, or QUIT. We also honor any other clear request to stop, such as "leave me alone" or "don't text me." You will get one confirmation message.

- **What opting out covers:** Opting out ends all text messages from that number. We also add your number to our suppression list, so it will not be texted again by us for any of our customers unless you opt back in.

- **For help:** Reply **HELP** or reach us through our [contact page](https://swayvia.com/contact).

- **To start again:** Reply **START** or **UNSTOP**, or contact us to be re-added.

Opting out of texts does not automatically stop calls or email, so let us know if you want those stopped too.

## 6. Phone calls and AI assistants

Some of our services use AI-assisted voice and text assistants. Where the law requires, the assistant will tell you it is an automated or AI system. Calls and messages may be recorded and transcribed for quality and record-keeping. You can ask to stop receiving calls at any time by telling the caller or by contacting us.

**Callbacks you request.** If you ask to be called during a text, email, chat, or phone conversation with us, our AI assistant may call you back at the number you give us. We will first ask you to confirm that you agree to an AI-assisted call. That callback is for your request only and does not sign you up for ongoing calls. If you check a form box agreeing to calls, we may also call you as described in that box.

## 7. Privacy and sharing of your information

Your privacy matters to us. Our full [Privacy Policy](https://swayvia.com/privacy) describes what we collect and how we use it. For text messaging specifically:

- **No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.**

- Text messaging opt-in data and consent records are not sold or shared for marketing purposes.

- We may share information with service providers that help us deliver messages (such as messaging and telephone platforms), and only as needed to operate the service. These providers are bound by confidentiality.

- We may disclose information when required by law.

## 8. Changes to this policy

We may update this policy from time to time. The "Last updated" date at the top shows when changes were last made. Continued use of our services after an update means you accept the changes.

## 9. Your rights

You may ask us at any time what information we hold about your phone number, ask us to correct or delete it, or withdraw your consent. Contact us using the details below.
